Terms of Use for Tonic Inc.

1. Acceptance of Terms

By downloading, installing, or using Tonic ("the App"), you agree to these Terms of Use ("Terms"). If you do not agree, please do not use the App.

2. Eligibility

You must be at least 18 years old and reside in a jurisdiction where our App is available. By using the App, you represent and warrant that you meet these requirements.

3. License Grant

Tonic Inc. grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate information when registering.
• You may delete your account at any time via the App's settings.

5. User-Generated Content

• You retain ownership of any content you post on your own Instagram account to unlock deals.
• By using the App, you grant Tonic Inc. a worldwide, royalty-free license to display your Instagram username and profile picture in connection with your use of the App.

6. Prohibited Conduct

You agree not to:

• Post or link to inappropriate, obscene, defamatory, or infringing content.
• Harass, threaten, or harm other users.
• Attempt to reverse-engineer, hack, or disrupt the App or its servers.

7. Enforcement & Termination

We reserve the right to suspend or terminate your access for violations of these Terms, at our sole discretion and without notice. Upon termination, your license to use the App ends immediately.

8. Disclaimers & Limitation of Liability

AS-IS: The App is provided "as is" without warranties of any kind.

Limitation of Liability: To the fullest extent permitted by law, Tonic Inc. and its officers, directors, and employees will not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the App.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Wisconsin.

10. Changes to Terms

We may revise these Terms from time to time. We will notify you of material changes by email to tonictheapp@gmail.com at least 30 days before they take effect.
